AllThroughChat is a software-as-a-service platform, not a retailer of the products listed by businesses using our platform.
1. About AllThroughChat
AllThroughChat provides tools to help businesses manage their online storefronts, inventory, consignment, orders, and customer communications. References to “we”, “us”, and “our” mean AllThroughChat. References to “you” mean the person or business using our services.
Our address is 45 Wesley Street, Gardens. Contact us at admin@allthroughchat.com.
2. Accepting these terms
By creating an account or using our services, you agree to these terms. If you use the platform on behalf of a business, you confirm that you have authority to bind that business. Any separate written agreement with us takes precedence where it expressly conflicts with these terms.
3. Your account
You must provide accurate account information, keep your login details secure, and ensure that people accessing your account are authorised to do so. You are responsible for activity carried out through your account, except to the extent caused by our breach of these terms or applicable law. Tell us promptly if you suspect unauthorised access.
4. Your business and your customers
Your business, not AllThroughChat, is the seller of products offered through your storefront. Providing the software does not make us a party to sales or consignment agreements between you, your customers, or your consignors.
You are responsible for your listings, stock information, pricing, taxes, product safety, delivery, refunds, customer service, and consignment arrangements. You must have the right to sell the goods you list and comply with applicable consumer protection, ecommerce, privacy, and other laws.
5. Fees and payment
Your subscription fees, any setup or usage charges, billing frequency, and applicable taxes will be set out in the pricing or proposal you accept before purchasing. Any renewal terms will also be disclosed before you agree to them. Third-party services may charge separate fees.
We will communicate changes to recurring fees in advance, including when they take effect. You may cancel before the changed fees apply. Refunds are governed by your agreed plan and applicable law; nothing in these terms excludes a refund you are legally entitled to receive.
6. Acceptable use
You may not use the platform for unlawful activity, fraud, unsolicited messaging, or the sale of prohibited goods. You may not upload malicious software, infringe another person's rights, attempt unauthorised access, or interfere with the security or operation of the service. Customer communications must comply with applicable consent requirements and messaging-provider policies.
7. Your content and data
You retain your rights to the content and data you provide. You give us permission to host, process, display, and transmit that content only as needed to provide and secure the services, follow your instructions, and comply with the law. You must have the necessary rights and lawful basis to provide it to us.
Each party must comply with applicable data protection law, including South Africa's Protection of Personal Information Act (POPIA) and, where applicable, the UK GDPR and Data Protection Act 2018. Where we process personal information on your behalf, we will enter into a data processing agreement setting out each party's responsibilities before that processing begins. Any international transfers of personal information must comply with applicable legal requirements. These terms do not replace that agreement or our Privacy Policy.
For information about our handling of personal information, read our Privacy Policy.
8. Our software and third-party services
We and our licensors retain the rights to the platform and its software. While your account is active, you may use the service for your business in accordance with your plan and these terms.
Integrations such as WhatsApp, payment providers, and delivery services are operated by third parties and may be subject to their own terms, fees, and availability. AllThroughChat is not affiliated with or endorsed by those providers unless expressly stated.
9. Availability and changes
We aim to provide a reliable service, but do not promise uninterrupted or error-free operation. Maintenance, network issues, and third-party outages may affect availability. We may update the platform over time and will give reasonable notice of material changes that adversely affect your use, where practicable. Any specific service-level commitments must be agreed separately in writing.
10. Cancellation and suspension
You may request cancellation by emailing us. Cancellation takes effect according to the billing and notice terms you accepted when subscribing, subject to applicable law.
We may restrict or suspend access where reasonably necessary to address non-payment, a material breach, a security risk, or a legal requirement. Where appropriate, we will notify you and give you a reasonable opportunity to resolve the issue before suspending access.
Before closing your account, contact us to arrange an export of your business data. We will explain the available formats and any applicable retention or deletion periods. Some records may need to be retained to meet legal obligations.
11. Responsibility and liability
You remain responsible for your business decisions and for reviewing the information you publish through the platform. We do not guarantee sales, revenue, or other business outcomes. Each party remains responsible for losses for which it is legally liable. Nothing in these terms excludes or limits liability, warranties, or consumer rights that cannot lawfully be excluded or limited.
12. Changes to these terms
We may update these terms and will notify you of material changes before they take effect. Changes will not apply retrospectively. If you do not accept a material change, you may stop using the service and request cancellation before it takes effect, subject to applicable law.
13. Governing law and contact
We provide services to businesses in South Africa and the United Kingdom. Unless a separate written agreement with us expressly provides otherwise, these terms are governed by South African law.
This choice of law does not exclude or override any mandatory rights or protections that apply under the laws of the United Kingdom or any other applicable jurisdiction. If you use our services as a consumer, nothing in these terms affects your statutory consumer rights, including any rights concerning the law or courts applicable to a dispute.
Please contact us first so we can try to resolve any concern. Nothing in these terms prevents you from approaching a court with jurisdiction, a relevant regulator, or an available dispute-resolution body.
Questions about these terms can be sent to admin@allthroughchat.com or addressed to AllThroughChat at 45 Wesley Street, Gardens.
